Earlyvillage is a Canadian childcare management platform operated from Calgary, Alberta and made available to childcare providers across Canada.

1. Our Privacy Principles

Earlyvillage provides software that helps childcare providers manage daily operations such as child and family records, attendance, scheduling, billing, family communication, incident documentation, staffing, and related administrative records.

Because this information can be particularly sensitive, especially when it relates to children, our privacy practices are guided by several principles.

We collect and use personal information only for reasonable and identified purposes. We seek to limit collection to information reasonably necessary for those purposes. We apply safeguards appropriate to the sensitivity of the information. We provide childcare providers with control over the operational information they maintain through Earlyvillage. We seek to be transparent about how information is processed and disclosed, including when service providers operate in other jurisdictions.

We do not sell personal information.

We do not use children’s personal information for behavioural advertising or create advertising profiles about children.

We do not use Customer Personal Information to train generalized artificial intelligence or machine-learning models.

We seek to retain personal information only for as long as reasonably required for the purposes for which it was collected, subject to applicable legal, contractual, security, and operational requirements.

2. The Different Roles of Earlyvillage and Childcare Providers

Earlyvillage handles personal information in two primary contexts.

2.1 Information processed for a childcare provider

Childcare centers, preschools, dayhomes, nonprofits, and other organizations using Earlyvillage are referred to in this policy as “Customers.”

Customers may use Earlyvillage to collect, create, maintain, and manage personal information concerning children, parents and guardians, educators, employees, contractors, prospective families, and other individuals connected with their childcare operations.

We refer to personal information processed through Earlyvillage on behalf of a Customer as “Customer Personal Information.”

The Customer generally determines why Customer Personal Information is collected, what information is entered into Earlyvillage, who within its organization may access it, how it is used in the Customer’s childcare operations, and what consent or other legal authority supports that processing.

Earlyvillage processes Customer Personal Information to provide the Services to the Customer and as otherwise permitted by our agreements and applicable law.

2.2 Information Earlyvillage collects for its own operations

Earlyvillage also collects personal information for purposes connected with operating our own business.

This can include information concerning Customer administrators, people who create accounts, website visitors, prospective Customers, people who request demonstrations, billing contacts, support contacts, and other people who communicate directly with Earlyvillage.

For this information, Earlyvillage determines the purposes for which the information is collected and used.

The descriptions in this section explain the practical relationship between Earlyvillage and its Customers. They do not eliminate or limit any responsibility imposed on either party by applicable privacy law.

3. Information Processed Through Earlyvillage

The information processed through Earlyvillage depends on the functionality a Customer uses and the information the Customer chooses to maintain.

Child information

Customer Personal Information about a child may include the child’s name, date of birth, age, photograph, program or classroom, location, enrollment information, attendance records, schedules, guardian relationships, emergency contacts, allergies, medication or other health-related information, dietary needs, care requirements, education or support considerations, incidents, activities, milestones, daily reports, notes, and other information reasonably maintained by the childcare provider.

Some of this information can be highly sensitive.

Parent and guardian information

Customer Personal Information about parents, guardians, and other authorized adults may include names, relationships to children, telephone numbers, email addresses, communication preferences, pickup or drop-off authorization, emergency contact information, messages, billing information, payment status, and account activity.

Employee and educator information

Customers may process information relating to employees, educators, contractors, and other staff, including names, contact information, roles, workplace locations, classroom assignments, schedules, availability, credentials where applicable, permissions, and operational activity associated with their work.

Attendance and scheduling information

Earlyvillage may process child and staff attendance information, check-in and check-out timestamps, attendance history, schedules, classroom assignments, staffing information, schedule changes, and information identifying the user responsible for particular actions or changes.

Incident and operational records

Customers may record information concerning incidents, including the type of incident, date and time, description, children or staff involved, actions taken, follow-up information, acknowledgments, staffing or ratio information, and related notes or records.

Incident records can contain health information or other sensitive information.

Communications

Earlyvillage may process messages and childcare communications, including sender and recipient information, message contents, associated children or classrooms, timestamps, delivery information where available, daily reports, announcements, and communication history.

Billing information

Earlyvillage may process information relating to childcare charges, invoices, balances, discounts, credits, subsidies, payment amounts, payment status, transaction identifiers, receipts, and payment failures.

Payment execution is handled through payment providers such as Stripe. Earlyvillage stores the billing state and payment references necessary to support its billing workflows.

Information processed directly by a payment provider is also subject to that provider’s applicable privacy practices.

4. Information Earlyvillage Collects Directly

When a person establishes or administers an Earlyvillage account, communicates with our team, requests a demonstration, obtains support, or otherwise interacts directly with Earlyvillage, we may collect information such as their name, work email address, telephone number, organization, role, account information, subscription information, billing contact information, communications with us, support requests, and other information they choose to provide.

For prospective Customers and business relationships, we may also maintain information concerning the organization, operational needs, product interests, communications with Earlyvillage, meeting information, and follow-up activity.

When the Services are used, our systems and infrastructure providers may generate technical records necessary to operate, secure, diagnose, and maintain the Services. These records can include IP addresses, browser or device information, timestamps, authentication events, application activity, errors, and security events.

5. How We Collect Personal Information

We collect personal information directly from individuals when they create or administer an account, contact us, request support, request information, communicate with our team, or otherwise provide information to Earlyvillage.

We receive Customer Personal Information from Customers and their Authorized Users when they use Earlyvillage.

Information is also generated when people perform actions through the Services, such as recording attendance, updating a record, creating a schedule, sending a message, recording an incident, or completing a billing workflow.

Our systems and service providers may automatically generate technical and security information when Earlyvillage is accessed.

We may also receive information from service providers involved in areas such as payments, authentication, communications, hosting, security, and other services necessary to operate Earlyvillage.

6. Why We Use Personal Information

We use Customer Personal Information primarily to provide the functionality requested by the Customer. This includes maintaining records, recording attendance, managing schedules, facilitating billing, enabling communications, maintaining incidents and other operational documentation, controlling access permissions, and otherwise operating Earlyvillage for the Customer.

We use account, contact, technical, and business information to establish and administer Customer relationships, authenticate users, provide customer support, manage subscriptions, secure the Services, investigate errors, detect fraud or abuse, communicate about accounts and Services, and comply with legal obligations.

We may use technical service information and aggregated or reasonably de-identified information to understand service performance, diagnose problems, improve reliability, and develop Earlyvillage.

We do not use identifiable children’s Customer Personal Information for advertising, unrelated marketing, generalized AI-model training, or unrelated commercial profiling.

7. Children’s Personal Information

Protecting children’s privacy is a particularly important part of how Earlyvillage approaches personal information.

Children do not independently create Earlyvillage accounts and are not intended to use Earlyvillage as independent account holders.

Information about children is generally entered or generated by childcare providers, their Authorized Users, or parents or guardians interacting through a childcare provider.

The childcare provider is responsible for determining which information about a child is reasonably necessary for its childcare operations and for ensuring that it has the consent or other legal authority required to collect and use that information.

Earlyvillage processes children’s information to provide the Services requested by the childcare provider.

We do not sell children’s personal information.

We do not use children’s personal information for behavioural advertising.

We do not create advertising profiles about children.

We do not use Customer Personal Information about children to train generalized artificial intelligence or machine-learning models.

We seek to apply privacy protections appropriate to the sensitivity of children’s information and to limit access to people and service providers who reasonably require it for legitimate purposes.

Parents and guardians seeking access to or correction of childcare records maintained through Earlyvillage should ordinarily contact their childcare provider directly. Earlyvillage will assist the Customer where reasonably necessary and required by applicable law or contract.

8. Consent and Other Legal Authority

Earlyvillage collects, uses, and discloses personal information with consent or other authority permitted or required by applicable privacy law.

The form of consent or other authority required can depend on the nature and sensitivity of the information, the purpose for which it is processed, the individual’s reasonable expectations, the jurisdiction involved, and other circumstances.

When Earlyvillage collects personal information directly, we identify the purposes of collection as required by applicable law.

When a Customer provides Customer Personal Information to Earlyvillage, the Customer is responsible for determining the appropriate consent or other legal authority supporting its collection, use, and disclosure of that information.

Special rules concerning children’s information can apply in certain provinces. Because children do not independently provide information to Earlyvillage through child accounts, Customer Personal Information about children is ordinarily provided by childcare providers or adults authorized to interact with the provider.

Where consent can legally be withdrawn, an individual may withdraw that consent subject to applicable legal restrictions, reasonable notice, contractual requirements, and information that must continue to be processed or retained for lawful purposes.

9. How Personal Information Is Disclosed

Earlyvillage does not sell personal information.

We disclose personal information only for purposes reasonably connected with operating the Services, complying with law, or as otherwise described in this policy.

Customers and Authorized Users

Customer Personal Information is made available to the Customer and to Authorized Users according to permissions established through the Customer’s account.

For example, administrators may access operational records, educators may access information required for their responsibilities, and parents or guardians may access information relating to children or accounts they are authorized to view.

Service providers

We use service providers to help operate Earlyvillage.

These providers may perform services relating to application and database infrastructure, payments, communications, email, authentication, customer support, security, monitoring, customer relationship management, and other business or technical functions.

Service providers that process Customer Personal Information on our behalf are required to be subject to appropriate confidentiality, privacy, security, and data-handling obligations.

Payment providers

Personal information necessary to process payments may be disclosed to payment processors and other financial-service entities involved in the transaction.

Professional advisers

We may disclose personal information where reasonably necessary to lawyers, accountants, auditors, insurers, security professionals, and other professional advisers.

Legal, regulatory, and safety requirements

We may disclose personal information where reasonably necessary or legally required to comply with applicable law, respond to lawful legal process, investigate fraud or unlawful activity, enforce our agreements, protect the security of the Services, or protect the rights or safety of Earlyvillage or another person.

Business transactions

If King Digital Inc. is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar transaction, personal information may be disclosed where reasonably necessary to evaluate or complete that transaction and subject to applicable privacy requirements.

10. Service Providers and Cross-Jurisdiction Processing

Earlyvillage is operated from Alberta and serves Customers throughout Canada.

We use service providers that may process personal information in provinces or countries different from the province in which the individual or Customer is located.

As a result, personal information may be processed elsewhere in Canada or outside Canada.

When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction, including lawful access by courts, governments, regulators, or law-enforcement authorities.

We maintain information about material service providers, the purposes for which they process personal information, and the jurisdictions in which relevant processing may occur.

For information about our current service-provider and cross-jurisdiction processing practices, contact our Privacy Officer at:

legal@earlyvillage.com

Earlyvillage uses contractual, organizational, and technical measures appropriate to the circumstances when service providers process Customer Personal Information on our behalf.

Customers may themselves have obligations concerning transfers of personal information between jurisdictions. Earlyvillage will make reasonably necessary information available to assist Customers with those obligations.

For example, Quebec privacy law can impose additional requirements before certain personal information is communicated or entrusted for processing outside Quebec.

11. Cookies and Similar Technologies

The Earlyvillage website and application may use cookies or similar technologies necessary for functions such as authentication, session continuity, security, and user preferences.

Our childcare Services are not designed around behavioural advertising, and we do not use children’s Customer Personal Information for behavioural advertising.

If Earlyvillage introduces non-essential tracking technologies that require additional notice or consent under applicable law, we will provide the required information and choices before using those technologies.

12. Marketing Communications

Earlyvillage may send Customers and prospective Customers communications concerning our products, company updates, relevant resources, events, and other Earlyvillage offerings.

Where required by applicable law, we obtain the consent or other authority required before sending commercial electronic messages.

Marketing communications sent by Earlyvillage include an unsubscribe mechanism where required.

A person who unsubscribes from marketing communications may still receive transactional or service-related communications, including account notices, billing communications, security notifications, service updates, and responses to support requests.

Messages sent by childcare providers through Earlyvillage are controlled by those Customers rather than by Earlyvillage for its own marketing purposes.

13. Artificial Intelligence

Earlyvillage does not use Customer Personal Information to train generalized artificial intelligence or machine-learning models.

If Earlyvillage provides an AI-assisted feature that processes Customer Personal Information to perform a function specifically requested by the Customer, that processing will be treated as part of providing the Services and will be subject to the applicable privacy, security, contractual, and service-provider requirements.

AI-assisted functionality does not change our commitment not to use Customer Personal Information for generalized model training.

14. Aggregated and De-identified Information

Earlyvillage may create aggregated statistical information or information that has been reasonably de-identified.

We may use that information to understand service performance, identify general usage patterns, improve reliability, develop functionality, plan our business, and perform internal analysis, provided that the information does not reasonably identify a child, Authorized User, Customer, or other individual.

We do not attempt to re-identify information that we maintain as de-identified except where reasonably necessary to test whether de-identification measures are effective or where otherwise permitted or required by law.

15. Retention and Deletion

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, subject to legal, contractual, operational, security, and recordkeeping requirements.

Customer Personal Information will ordinarily be maintained while a Customer uses Earlyvillage.

Following termination or expiry of a Customer Subscription, the Customer will generally have an opportunity to retrieve available Customer Data for 30 days in accordance with the Earlyvillage Customer Terms of Service.

After the applicable retrieval period, Customer Data may be removed from active systems according to our retention and deletion practices.

Some information may be retained longer where reasonably necessary to comply with law, maintain financial or corporate records, investigate fraud or security incidents, resolve disputes, establish or defend legal claims, or meet other legitimate legal requirements.

Information deleted from active systems may remain temporarily in backups until those backups are overwritten or deleted through normal backup processes. Information retained in backups is not used for unrelated purposes merely because it remains in backup storage.

Customers remain responsible for determining the retention periods required for their own childcare and operational records.

16. Security

Earlyvillage uses administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of the personal information we process.

These safeguards can include access and authorization controls, authentication measures, encryption, logging, secure communications, backups, security monitoring, restrictions on personnel access, service-provider controls, and security procedures appropriate to the applicable systems.

Access to Customer Personal Information is limited to personnel and service providers who reasonably require access for legitimate purposes.

No internet-based service or security system can guarantee absolute security.

If you believe that an Earlyvillage account or personal information may have been compromised, contact:

legal@earlyvillage.com

17. Privacy and Security Incidents

Earlyvillage maintains procedures for identifying, investigating, containing, and responding to privacy and security incidents.

Where a Security Incident affects Customer Personal Information, Earlyvillage will notify the affected Customer without undue delay in accordance with its contractual obligations.

Earlyvillage will take reasonable measures appropriate to the circumstances to investigate the incident, contain it, mitigate reasonably foreseeable harm, restore security where necessary, and reduce the likelihood of recurrence.

We will notify affected individuals, privacy regulators, or other authorities when required by the privacy law applicable to the incident.

Because notification and reporting requirements differ between Canadian jurisdictions, Earlyvillage assesses regulatory obligations according to the law applicable to the particular incident.

18. Access and Correction

Individuals may have rights under applicable Canadian privacy laws to request access to personal information about themselves and to request correction of inaccurate or incomplete information.

These rights are subject to exceptions provided by applicable law.

Customer-controlled information

When personal information is maintained through Earlyvillage on behalf of a childcare provider, the individual should ordinarily direct the request to that childcare provider.

For example, a parent or guardian seeking access to a child’s attendance information, child profile, incident records, family communications, or similar childcare records should ordinarily contact the childcare provider responsible for those records.

Earlyvillage will provide reasonable assistance to the Customer where necessary to enable it to respond to a valid privacy request.

Information controlled directly by Earlyvillage

Requests concerning personal information maintained by Earlyvillage for its own purposes may be submitted in writing to:

Privacy Officer
King Digital Inc., doing business as Earlyvillage
122 Silverado Creek Crescent SW
Calgary, Alberta T2X 0C5
Canada
legal@earlyvillage.com

We may take reasonable steps to verify the identity and authority of the person making the request.

We will respond within the timeframe required by the privacy law applicable to the request.

19. Requests Concerning Deletion or Withdrawal of Consent

Individuals may request deletion of personal information or withdrawal of consent where such rights apply.

These rights are not absolute.

Information may need to continue to be retained or processed because of childcare recordkeeping requirements, legal obligations, contractual obligations, financial recordkeeping, security and fraud prevention, dispute resolution, or other purposes permitted or required by law.

Where the relevant information is controlled by a childcare provider, the request should ordinarily be directed to that provider.

Earlyvillage will provide reasonable assistance where required by law or our agreement with the Customer.

20. Accuracy

Earlyvillage takes reasonable steps appropriate to its role to support the accuracy of personal information.

Customer Personal Information is frequently created, entered, and updated by Customers and their Authorized Users.

Customers are responsible for ensuring that the information they maintain through Earlyvillage is sufficiently accurate, complete, and current for the purposes for which they use it.

Users should correct information when they become aware that it is inaccurate or incomplete.

21. Employee and Educator Information

Earlyvillage may process information concerning educators, employees, contractors, and other childcare staff on behalf of Customers.

The Customer remains responsible for determining the legal authority applicable to its collection and use of employee or educator information.

Applicable Canadian privacy laws may contain specific provisions concerning employee personal information, and those rules can vary by jurisdiction.

Earlyvillage processes such information to provide the Services and as otherwise permitted by our agreements and applicable law.

22. Third-Party Services and Links

Earlyvillage may integrate with or link to services operated by third parties.

Where a third party independently determines why and how it processes personal information, its own privacy policy and terms apply to that processing.

This Privacy Policy does not govern the independent privacy practices of third parties.

Where a third party processes Customer Personal Information on Earlyvillage’s behalf as a service provider, that processing is addressed by the service-provider provisions of this Privacy Policy and our contractual arrangements.

23. Privacy Officer and Accountability

King Digital Inc. maintains responsibility for its privacy program and has designated a Privacy Officer as the point of contact for questions, requests, and complaints relating to Earlyvillage’s privacy practices.

The Privacy Officer can be contacted at:

Privacy Officer
King Digital Inc., doing business as Earlyvillage
122 Silverado Creek Crescent SW
Calgary, Alberta T2X 0C5
Canada
legal@earlyvillage.com

Our privacy program includes policies and practices concerning the collection, use, disclosure, safeguarding, retention, access, correction, and deletion of personal information appropriate to our activities.

24. Privacy Laws Across Canada

Earlyvillage provides Services to childcare organizations across Canada.

The privacy law applicable to particular personal information or processing activity depends on factors including where a Customer operates, where the individual is located, where the collection, use, or disclosure occurs, whether information is transferred between jurisdictions, the nature of the Customer, and whether sector-specific legislation applies.

Canada’s federal private-sector privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA), applies to many commercial activities and continues to apply in circumstances including certain interprovincial and international transfers of personal information.

Alberta, British Columbia, and Quebec each have generally applicable private-sector privacy legislation that has been recognized as substantially similar to PIPEDA. Where one of those provincial laws applies, it may govern the relevant activity instead of PIPEDA.

Depending on the circumstances, Earlyvillage’s handling of personal information may therefore be subject to laws including:

Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA); Alberta’s Personal Information Protection Act (PIPA); British Columbia’s Personal Information Protection Act (PIPA); Quebec’s Act respecting the protection of personal information in the private sector; and other applicable federal, provincial, territorial, or sector-specific privacy laws.

More than one privacy law can apply to a Customer relationship, data transfer, or processing activity.

Nothing in this Privacy Policy limits any privacy right or obligation that cannot lawfully be limited or waived.

25. Quebec Privacy Requirements

If Earlyvillage conducts business in Quebec or processes personal information subject to Quebec’s private-sector privacy legislation, additional requirements under Quebec law may apply.

These requirements can include enhanced transparency and consent rules, privacy impact assessments in specified circumstances, requirements relating to confidentiality incidents, governance and privacy policies, and assessments and written agreements before certain personal information is communicated or entrusted for processing outside Quebec.

Earlyvillage will apply these requirements where they are legally applicable to its activities.

Customers operating in Quebec may also have their own obligations under Quebec privacy law. Earlyvillage will provide reasonably necessary information about its Services and service providers to assist Customers in evaluating those obligations.

26. Changes to This Privacy Policy

We may update this Privacy Policy when our Services, processing practices, service providers, or legal obligations change.

When we update the policy, we will change the Effective Date displayed at the top.

If a change materially affects how we collect, use, or disclose personal information, we will provide additional notice where appropriate or required by law.

If applicable law requires consent before information can be used for a materially different purpose, we will obtain the required consent before undertaking that processing.

27. Questions and Complaints

Questions, concerns, requests, and complaints relating to Earlyvillage’s privacy practices should be directed to:

Privacy Officer
King Digital Inc., doing business as Earlyvillage
122 Silverado Creek Crescent SW
Calgary, Alberta T2X 0C5
Canada
legal@earlyvillage.com

We will investigate privacy complaints and respond according to the law applicable to the request or complaint.

Individuals may also have the right to contact the privacy regulator responsible for their jurisdiction or circumstances.

Depending on the matter, this may include the Office of the Privacy Commissioner of Canada, the Office of the Information and Privacy Commissioner of Alberta, the Office of the Information and Privacy Commissioner for British Columbia, the Commission d’accès à l’information du Québec, or another applicable provincial or territorial privacy authority.

We encourage individuals to contact us first so that we have an opportunity to understand and address their concern.
